Terms of Service
Honeypop Loyalty App (“the App”) provides merchants with loyalty program tools, enabling rewards, points, and customer engagement on Shopify-supported stores. By installing or using the App, you agree to comply with and be bound by these Terms of Service (“Agreement”).
1. General
This Agreement applies to all users of the Honeypop Loyalty App, including “Merchants” (individuals or organizations using the App to manage loyalty programs for customers) and “Customers” (individuals interacting with loyalty programs in Shopify stores). “Users” refers to all individuals accessing the App, including employees, representatives, or agents of a Merchant. If you use the App on behalf of another legal entity, such as a company, you represent that you have the authority to bind that entity to this Agreement. Your continued access to and use of the App signifies your acceptance of the terms.
2. Services Provided
Honeypop Loyalty App offers merchants features such as loyalty points, VIP tiers, and referral tracking to increase customer engagement. All services provided are subject to this Agreement.
3. Acceptance
By accessing or using any service provided by Honeypop, you acknowledge and accept these Terms of Service. If you do not agree, you are not permitted to use the App.
4. Subscription and Fees
- Subscription Services: Access to certain Honeypop features requires a paid subscription, available through different plan tiers in the Shopify App Store.
- Service Fees: You agree to pay all fees specified in your subscription plan. Fees are non-refundable unless otherwise specified in a separate agreement.
- Usage Limits and Overage Fees: Services may be subject to usage limits, including on the number of Users, customers, and points. Exceeding these limits may incur additional fees.
5. Account Registration and Security
- Each User must register and create an account with Honeypop, providing accurate information. You are responsible for safeguarding your account credentials and all activities that occur under your account.
- If you suspect unauthorized access, you must notify Honeypop immediately.
- Honeypop reserves the right to suspend or terminate any account for misuse or violation of this Agreement.
6. Intellectual Property Rights
- Honeypop retains ownership of all intellectual property rights in the App, including content, design, and functionality.
- You are granted a limited license to use the App only for purposes directly related to your Shopify store.
- Unauthorized use, reproduction, modification, or distribution of Honeypop’s intellectual property is strictly prohibited.
7. Privacy Policy and Data Collection
Honeypop collects and uses data as outlined in our Privacy Policy. By using the App, you consent to our data collection, usage, and sharing practices as described in the Privacy Policy.
- Merchant Data and User Content: Merchants are responsible for obtaining all necessary consents and permissions for data collection under applicable laws, including for sharing data with Honeypop.
- Compliance with Privacy Laws: Merchants must ensure compliance with privacy, data protection, and anti-spam laws in their jurisdiction. Merchants are responsible for notifying customers of data collection and obtaining consent as required.
8. Updates and Changes to Services and Terms
- Honeypop reserves the right to modify or update any part of the App and this Agreement at any time. Any changes to this Agreement will be posted on this page and are effective immediately.
- Your continued use of the App after any updates constitutes acceptance of the revised Terms.
9. Usage Limits and Equipment
The App may have usage limits related to points, referrals, or customer activity. Merchants are responsible for adhering to these limits and are responsible for maintaining any equipment needed to access the App.
10. Warranties and Limitation of Liability
- The Honeypop Loyalty App is provided “as is” without any warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
- To the extent permitted by law, Honeypop will not be liable for any damages, loss of profits, data loss, or business interruptions resulting from your use of the App.
11. Indemnification
You agree to indemnify and hold harmless Honeypop and its affiliates, directors, officers, employees, and agents from any claims or damages arising out of your use of the App or any violation of this Agreement.
12. Governing Law
This Agreement is governed by the laws of [your jurisdiction]. Any disputes arising from or relating to this Agreement will be resolved in the courts of [applicable jurisdiction].
13. Termination
- Honeypop may terminate or suspend your access to the App for any conduct that violates this Agreement.
- Upon termination, you will no longer have access to the App, and all data may be permanently deleted.
14. Security and Maintenance
- Periodic maintenance may temporarily suspend access to the App without prior notice.
